1. Scope and Operator

1.1. These General Terms and Conditions ("GTC") govern the use of the website proxli.ch and the services offered through it ("Service"), operated by x y, [PO BOX ADDRESS], Switzerland ("Operator").

1.2. By using the Service or placing an order, you ("User" or "Customer") agree to these GTC. If you do not agree, do not use the Service.

2. Description of the Service

2.1. The Service allows the User to submit card game decklist data and order the production of printed proxy cards based on that input.

2.2. To fulfill an order, the Service assembles print-ready files from the User's decklist input and uses standard-resolution images sourced from publicly available card databases.

2.3. The Service may perform technical processing necessary for production, including file assembly, layout preparation, format conversion, and print optimization.

2.4. The Service includes order intake, payment processing, production coordination, and shipment to the delivery address provided by the User.

3. Role of the Service and User Responsibility for Content

3.1. The User is solely responsible for the content of any files or printed products created through the Service, including the selection of card images and decklist data submitted.

3.2. By using the Service, the User represents and warrants that:

  • (a) their use of the ordered files and printed products falls within the scope of private use as defined by Art. 19 URG (Swiss Copyright Act);
  • (b) they will not use the files or printed products for commercial purposes, public distribution, or resale;
  • (c) they accept full legal responsibility for any copyright or other legal implications arising from their use of the Service.

3.3. The User acknowledges that the card images used by the Service may be protected by third-party intellectual property rights.

3.4. The Service acts as a technical production service. It does not provide legal advice.

4. Orders and Contract Formation

4.1. An order is placed when the User submits the order form through the website.

4.2. A binding contract for production is formed only once payment has been successfully completed and the Operator accepts the order.

4.3. The Operator reserves the right to refuse or cancel an order if there are reasonable grounds to believe the requested content is unlawful or inconsistent with these GTC.

5. User Consent

5.1. Before placing an order, the User must confirm acceptance of the GTC and Privacy Policy.

5.2. By placing an order, the User confirms that they intend to use any resulting files and printed products exclusively for private, non-commercial purposes within the meaning of Art. 19 of the Swiss Copyright Act (URG).

6. Prices and Payment

6.1. Prices are as listed on the website. All prices are in Swiss Francs (CHF) and include VAT where applicable.

6.2. Payment is due at the time requested by the Service. The Operator may require full prepayment before production begins.

6.3. The Operator may use third-party payment processors. Their own terms and privacy policies may apply.

6.4. The Operator reserves the right to adjust prices at any time. Price changes do not affect orders already accepted.

7. Production and Delivery

7.1. The User is responsible for ensuring that submitted decklist data is accurate and complete.

7.2. Production and delivery times are estimates only and are not binding unless explicitly agreed in writing.

7.3. Risk of loss passes to the User upon handover to the postal service, to the extent permitted by applicable law.

7.4. The Operator is not liable for delays caused by payment providers, postal services, or other third parties.

8. Defects and Complaints

8.1. The User must report any obvious defects in writing within 7 days of delivery.

8.2. In the event of justified defects, the Operator may reprint the order, provide a refund, or offer another appropriate remedy.

8.3. The Operator is not liable for defects caused by inaccurate decklist data or user input errors.

9. No Warranty

9.1. The Service is provided "as is" and "as available," without warranties of any kind, except where mandatory law provides otherwise.

10. Limitation of Liability

10.1. To the maximum extent permitted by Swiss law, the Operator's liability is excluded, except in cases of intentional misconduct or gross negligence.

10.2. Any liability for justified claims relating to a specific order is limited to the value of that order.

11. Intellectual Property

11.1. The Operator does not acquire any intellectual property rights in the User's submitted decklists or content.

11.2. The User remains solely responsible for ensuring that the requested reproduction is lawful.

12. Data and Privacy

12.1. The Service processes personal data for the purpose of receiving, processing, and delivering orders.

12.2. The Operator processes personal data in accordance with the Swiss Federal Act on Data Protection (DSG).

13. Modification and Termination

13.1. The Operator may modify these GTC at any time. The current version is always available on the website.

13.2. Orders already accepted are governed by the GTC in effect at the time of acceptance.

14. Governing Law and Jurisdiction

14.1. These GTC are governed by Swiss law.

14.2. The exclusive place of jurisdiction is Switzerland, subject to any mandatory statutory provisions.
